Legal Requirements for Training

Responsibility for training

Responsibility for awareness of relevant legislation, standards, codes of practice etc. lies with each workplace participant,and responsible individuals within the organization of employment. Responsibilities are detailed in legislation, referenced Standards, Codes of Practice and OH&S Acts in Federal and State legislation.

The Acts are generally supported by Regulations, which are more specific and prescriptive. In each case legislation provides a range of duties for each workplace participant. Acts and regulations impose obligations on persons who may affect the safety of others by their acts or omissions.

Ignorance is no Defence.

Qualifications Of Personnel

AS/NZS 2381.1: states that:
"The design, construction, maintenance, testing and inspection of installations covered by this Standard shall be carried out only by competent persons whose training has included instruction on the various types of protection and installation practices, relevant rules and regulations and on the general principles of area classification. The competency of the person shall be relevant to the type of work to be undertaken. Appropriate continuing education or training should be undertaken by personnel on a regular basis."
